Hello All,
I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .
My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. The time for rhetoric is over. It�s time for leadership and action. That is why AARP, the Business Roundtable and the Service Employees International Union, organizations that often hold different views, are coming together with �Divided We Fail� � a national effort to help fix this problem and ensure that all Americans have access to the affordable, quality health care they deserve.
The United States is reaching a tipping point. With millions of Americans concerned about their health and long-term financial security, they fear the future will not be as prosperous for their children and grandchildren. If that happens, it will be the first time in American history. That is unacceptable.
Sharply increasing health care costs continue to burden workers and businesses alike while sapping our nation�s competitive strength. In fact, more than half of the CEOs of America�s largest employers cite rising health care costs as the most significant pressure facing their companies. At the same time, workers are facing double jeopardy: a broken health care system and a deep uncertainty about how to pay for it. And as the presidential campaigns, primaries and elections continue to dominate the news, we can expect a great deal of finger-pointing for this quagmire.
As leaders of three prominent business, labor and consumer organizations, we took our shared message to Capitol Hill this week and challenged our elected leaders to put aside partisan differences and join us by pledging to create meaningful solutions to the health care challenges that burden our nation. We believe that only by working together � corporations, government, individuals and families � can we address America�s health care crisis. If our three organizations can put aside our ideological differences to create real solutions, then Congress can, too.
Our challenge stands for all who are willing to rise to it. As we enter the presidential election season, we call on our nation�s leaders to offer real solutions to the critical issues facing our nation. We need leaders who are willing to take a serious look at these issues, those who understand that the complexities are too important to be glossed over by platitudes and sound bites and who are ready to get the job done if elected.
The time for action is now. The problems are complex, and the answers will require hard choices. We must start by coming together. From there, we can work to craft fair and bipartisan solutions. Our organizations, and the Americans we represent, are leading the charge for positive change. We truly hope that Congress will follow our lead. Divided we fail, but together we can do anything.

If you have successfully transfered your PD after your I-140 approval. Please post your experience.
I have seen I-140 threads for a while ..everyone have a opinion ..but none of you have gone through it....its misleading we can quote different websites and USICS documents ..only people who actually transfered PD can share. How they did it. Whats the process. Please respond to this thread only if you have successfully transfered PD after I-140 approval.

I'm currently working on L1B visa from company A. My present employer applied H1B visa also for me and it got approved around in the August last year. Now I'm planning to change my visa status to H1B.
So I would like to know the options that I have to get my visa status changed to H1b.
1) Can I transfer my H1B to some other company now as my H1B already approved? Is it possible?
If it is, how can I change my status?
2) What is the procedure if I have my current employer do my visa status changed to H1B? Do I need to leave US and come back to take that effect?
Please kindly reply to my questions.

Hello gang! I have a quick question! Has anyone had issues with the prevailing wage being too low? The attorneys requested the prevailing wage from the SWA and it came back really high twice, so they then submitted a private wage survey that my company conducted with a reputable firm and it was rejected. The attorneys have said that they will now appeal the case directly to DOL. Has anyone had to go through this? If so, how long does appealing to DOL take? And, any info on success rate with the appeals to DOL?
